EMILY A. BIFFEN is an associate attorney with a focus on tax-efficient trust and estate planning, and nonprofit formation and governance, for local and national clients. Emily advises on Delaware trust law, including the establishment, transfer, and construction of trusts to achieve a client’s personal or business goals. She routinely drafts and reviews Delaware trust agreements, such as directed trusts, dynasty trusts, and asset protection trusts, and opines on the validity of such trusts under Delaware law. Emily advises local Delaware residents, as well as individuals, financial institutions, and corporate trustees across the country, on strategic and efficient trust planning. She works closely with out of state counsel on multistate matters to ensure compliance with, and optimization of, Delaware’s unique trust laws, and regularly handles the modification or transfer of the situs of a trust to take advantage of Delaware’s favorable regulations. In addition to advising individuals and institutions on matters of trust law, Emily assists charities and nonprofits with formation and compliance matters, including eligibility for tax exempt status and related regulatory filings.
For many individual clients, trust planning is an integral part of their broader estate plan. Emily assists local Delaware individuals and families with all aspects of their estate planning, including wills, powers of attorney, healthcare directives, and relevant trust arrangements. She also advises multigenerational families on the practical and tax-efficient transfer of their personal assets or business legacy.
